Copyright & Intellectual Property Policy

Respect for Intellectual Property

OQANDA respects the intellectual property rights of others and expects its users and partners to do the same. We respond to notices of alleged copyright infringement in accordance with the EU Digital Services Act (DSA) and applicable law.

Reporting Copyright Infringement

If you believe that content on the OQANDA platform infringes your copyright, please send a written notice to:

Your notice should include:

  1. Identification of the copyrighted work you believe has been infringed.
  2. Identification of the material on our platform that you believe is infringing, including a URL or description sufficient to locate the content.
  3. Your contact information: name, address, email address, and telephone number.
  4. A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate and that you are the copyright owner or authorised to act on their behalf.
  6. Your physical or electronic signature.

Our Response

Upon receiving a valid copyright infringement notice:

  1. We will review the notice within 5 business days.
  2. If the notice is valid, we will promptly remove or disable access to the infringing content.
  3. We will notify the user who uploaded the content of the takedown and the reason.
  4. The affected user may submit a counter-notice if they believe the content was removed in error.

Counter-Notices

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to copyright@oqanda.com including:

  1. Identification of the removed content and its location on the platform before removal.
  2. A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification.
  3. Your name, address, and email address.
  4. Your consent to the jurisdiction of the courts of Frankfurt am Main, Germany.

Upon receiving a valid counter-notice, we may restore the content within 10–14 business days unless the original complainant initiates legal proceedings.

Repeat Infringers

OQANDA will, in appropriate circumstances, disable and/or terminate the accounts of users who are repeat infringers.

Merchandise and Artist IP

All merchandise sold on the OQANDA Store is produced under license from the relevant rights holders. If you believe merchandise on our platform infringes your intellectual property, please contact us at copyright@oqanda.com.
