1. Scope and Operator

These Terms of Service ("Terms") govern the use of the OQANDA platform ("Platform"), operated by:

By creating an account or using the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.

2. Description of Service

OQANDA is a live text-based Q&A platform connecting artists, authors, and other public figures ("VIPs") with their fans ("Users") through moderated, real-time interview sessions ("Events"). The Platform also includes a limited-edition merchandise store ("Store") where Users can purchase products linked to Events.

3. Account Registration

3.1 You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3.2 You may not create multiple accounts, share your account with others, or use automated systems to create accounts.

3.3 We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct

4.1 When participating in Events, you agree to:

• Ask respectful and relevant questions
• Not submit content that is defamatory, threatening, harassing, obscene, or otherwise objectionable
• Not impersonate other individuals or entities
• Not attempt to circumvent moderation or technical restrictions
• Not use the Platform for commercial solicitation or advertising

4.2 OQANDA reserves the right to remove content and suspend accounts that violate these guidelines without prior notice.

5. Events and Q&A Sessions

5.1 Events are live, moderated sessions. Questions submitted by Users are reviewed by a moderator before being presented to the VIP. Not all questions will be selected.

5.2 OQANDA does not guarantee that any particular question will be answered.

5.3 Event schedules may change. OQANDA will make reasonable efforts to notify registered Users of changes.

5.4 Event replays, when available, are accessible only to Users who registered for the original Event.

6. Content Ownership and Licensing

6.1 Your content: You retain ownership of the questions you submit. By submitting a question, you grant OQANDA a non-exclusive, worldwide, royalty-free license to display, store, and reproduce your question within the context of the Event and any associated replay.

6.2 VIP content: Answers provided by VIPs during Events are subject to separate agreements between OQANDA and the VIP. Users may not reproduce, distribute, or commercially exploit VIP responses without written permission from OQANDA.

6.3 Platform content: All other content on the Platform — including design, logos, text, images, and software — is owned by or licensed to OQANDA and protected by copyright and intellectual property laws.

7. Store and Purchases

7.1 The Store offers limited-edition merchandise linked to Events. All prices are displayed in EUR and include applicable VAT for customers within the European Union.

7.2 Purchases are processed through Stripe. OQANDA does not store your payment card details.

7.3 Product availability is limited and displayed quantities are updated in real time. OQANDA does not guarantee availability.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your personal data.

9. Disclaimer and Limitation of Liability

9.1 The Platform is provided "as is" without warranties of any kind. OQANDA does not warrant that the service will be uninterrupted, error-free, or secure.

9.2 To the extent permitted by law, OQANDA's liability is limited to direct damages caused by intentional misconduct or gross negligence. OQANDA is not liable for indirect, incidental, or consequential damages.

9.3 OQANDA is not responsible for the accuracy, completeness, or reliability of content provided by VIPs or Users.

10. Modifications

OQANDA may update these Terms from time to time. We will notify registered Users of material changes via email. Continued use of the Platform after notification constitutes acceptance of the updated Terms.

11. Termination

You may delete your account at any time by contacting support@oqanda.com. OQANDA may terminate or suspend your account for violation of these Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. The courts of Frankfurt am Main shall have exclusive jurisdiction for disputes arising from these Terms, except where mandatory consumer protection laws require otherwise.
